1. Agreement to Terms

By downloading, accessing or using the NetCarb mobile application or website, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use NetCarb.

2. The Service

NetCarb estimates the carbohydrates in a meal from a photo. Photos are analyzed by an AI service, and the results are estimates that may be inaccurate. The app also includes tools such as a meal history and a bolus calculator.

3. Medical Disclaimer

MEDICAL DISCLAIMER: NetCarb is NOT a medical device. It is a carbohydrate estimation tool designed for informational purposes only. It should NOT be used as a substitute for professional medical advice, diagnosis or treatment.

Carb estimates and bolus calculations are approximations and may be wrong for some foods, portions or individuals. Always check them yourself, especially before dosing insulin, and consult your healthcare provider before making changes to your diabetes management plan. You use NetCarb's estimates at your own risk.

4. Accounts and Free Scans

  • You can try a limited number of scans without an account. Free scan limits apply per account, per app installation and per network.
  • You can sign in with your email address or with Google. An account is required to buy Premium.
  • You are responsible for keeping your sign-in details secure and for activity on your account.
  • Do not try to get around free scan limits, for example by creating multiple accounts or resetting app data.

5. Premium, Free Trials and Billing

  • Premium is offered as a monthly or yearly subscription, or as Lifetime Premium, a one-time purchase with no recurring charges. Prices are shown before you buy and may vary by country and currency.
  • Android: Purchases are made through Google Play and are also subject to Google Play's terms. Web: Payments are processed by Stripe.
  • Free trials: Monthly and yearly subscriptions may include a 7-day free trial for eligible new subscribers. Unless you cancel before the trial ends, your subscription starts automatically and you are charged the price shown.
  • Automatic renewal: Subscriptions renew automatically at the end of each period until you cancel. Cancel at least 24 hours before the renewal date to avoid the next charge. After cancelling, you keep Premium until the end of the period you have paid for.
  • How to cancel: On Android, open the Google Play Store and go to Profile > Payments & subscriptions > Subscriptions. For web subscriptions, use the Stripe billing portal, which you can open from the app, or contact us. Uninstalling the app does not cancel a subscription.
  • Refunds: Google Play purchases are refunded under Google Play's refund policy; you can request a refund through Google Play. For web purchases made through Stripe, contact us at support.netcarb@gmail.com. Where local law gives you a right to a refund, we will honor it.
  • We may change prices in the future. Price changes for existing subscriptions will be notified in advance, as required by Google Play, Stripe or applicable law.

6. License and Acceptable Use

We grant you a personal, non-exclusive, non-transferable license to use NetCarb for your own non-commercial purposes. You agree not to:

  • Copy, modify or resell NetCarb or its content
  • Decompile, reverse engineer or try to access our servers or data without permission
  • Overload, disrupt or automate access to the service
  • Upload unlawful, obscene or offensive content, or content you don't have the right to share
  • Use NetCarb to harass or harm others

7. Your Content

You keep all rights to the photos you submit. You give us permission to process them only to provide the service, as described in our Privacy Policy.

8. Availability and Changes

We work to keep NetCarb available, but we do not guarantee it will be uninterrupted or error-free. We may change, suspend or discontinue features at any time.

9. Disclaimer of Warranties

NetCarb is provided "as is" and "as available" without warranty of any kind, either express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement.

10. Limitation of Liability

To the extent permitted by law, NetCarb and its suppliers are not liable for any indirect, incidental or consequential damages, including loss of data or profit, or for any health outcome resulting from reliance on carb estimates or calculations. Our total liability for any claim is limited to the amount you paid for NetCarb in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

11. Termination

You can stop using NetCarb at any time and ask us to delete your account. We may suspend or end access for accounts that break these terms.

12. Modifications to Terms

We may update these Terms of Service from time to time. We will update the "Last Updated" date above, and for significant changes we will tell you in the app. Continuing to use NetCarb after an update means you accept the new terms.

13. Governing Law

These terms are governed by the laws of the jurisdiction in which NetCarb is operated, without regard to conflict-of-law rules. This does not take away any protections you have under the consumer laws of the country where you live.
